You probably can\u2019t afford that.<br \/>\nIf you\u2019re a homeowner or a small landlord with a triplex, what typically happens is you try to evict them and they say,<br \/>\n\u201cHey, we have a lease,\u201d or \u201cWe\u2019re under rent control,\u201d and they produce a lease you supposedly signed\u2014or your dad signed\u2014even if he has passed away.<\/p>\n<h2>Where a forensic document examiner comes in to save the landlord.<\/h2>\n<p>This is exactly where a forensic document examiner comes in, because you may not be able to find copies of the previous leases.<br \/>\nBut there\u2019s usually a pattern.<br \/>\nIf your dad (for example) rented properties for twenty years, he probably had a standard lease.<\/p>\n<p>And if the lease that shows up doesn\u2019t match the formatting, the font, the notary, the timing\u2014those details matter.<br \/>\nThat\u2019s what an examiner looks at. We investigate where (if anywhere) the lease deviates from the known, normal set.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-2431\" src=\"https:\/\/bartbaggett.com\/blog\/wp-content\/uploads\/2025\/12\/vsc2-tiny-forensic-equipment2.jpeg\" alt=\"\" width=\"360\" height=\"221\" srcset=\"https:\/\/bartbaggett.com\/blog\/wp-content\/uploads\/2025\/12\/vsc2-tiny-forensic-equipment2.jpeg 360w, https:\/\/bartbaggett.com\/blog\/wp-content\/uploads\/2025\/12\/vsc2-tiny-forensic-equipment2-300x184.jpeg 300w\" sizes=\"auto, (max-width: 360px) 100vw, 360px\" \/><\/p>\n<p>If you\u2019re a landlord and a tenant has manufactured a lease, you can win in court and finally get them evicted so you can turn the property.<br \/>\nBut you\u2019ll probably need a real estate attorney and a forensic document examiner to help prove the case.<br \/>\nAnd yes\u2014they will lie. They\u2019ll say you signed it, or your friend signed it, or \u201cthis is that.\u201d<\/p>\n<p>Sometimes the notary is a friend of theirs.<br \/>\nIf you\u2019re lucky, you can find the computer file where they manufactured it.<br \/>\nYou can also look at the paper and the age of the paper.<\/p>\n<p>I had a case almost twenty years ago where someone downloaded a last will and testament template, and the copyright date was two years after the person died.<br \/>\nIt\u2019s pretty hard to sign a will when you\u2019re dead, right?<\/p>\n<h2>Is it worth the fight?<\/h2>\n<p>So you\u2019re looking for clues to determine if a lease is false or not.<br \/>\nWe\u2019ve handled cases like this in San Francisco, Tennessee, Dallas, and Los Angeles, plus with other experts around the country.<br \/>\nIt\u2019s not uncommon.<\/p>\n<p>The real question is: is it worth the fight?<br \/>\nIs it worth pushing to get the person evicted, get the property back, and turn it\u2014 or is it better to let them stay?<\/p>\n<p>In most cases, if a tenant is forging leases, they\u2019re way behind, they\u2019re under rent control, and they want to stay forever.<br \/>\nSo yes\u2014this is often financially viable to fight.<\/p>\n<p>If you own property in California, you have a second layer of problems.<br \/>\nCalifornia is not landlord-friendly.<br \/>\nDuring COVID, there were cases where someone stayed in a property for two and a half years without paying rent because the state made eviction so difficult.<br \/>\nThat\u2019s why a lot of people prefer owning in landlord-friendly states like Texas or Tennessee, where you can actually evict someone if they\u2019re not paying.<\/p>\n<p>If someone doesn\u2019t pay rent, that\u2019s money out of your business and your family\u2019s pocket.<br \/>\nBut some states and some tenants don\u2019t see it that way.<br \/>\nThere\u2019s this idea that \u201clandlords are rich and tenants are poor.\u201d<br \/>\nThat\u2019s not the truth.<br \/>\nMost landlords in the U.S. are mom-and-pop businesses with one to three rental units.<br \/>\nIt\u2019s their nest egg.<\/p>\n<p>So when someone doesn\u2019t pay rent for four months, that\u2019s $12,000 gone\u2014and that isn\u2019t right.<\/p>\n<h2>What to do if you\u2019re dealing with a forged lease<\/h2>\n<p>If you\u2019re in a situation where someone forged a lease and they\u2019re trying to stay (especially under rent control),<br \/>\nyou\u2019ll likely need a forensic document examiner and an attorney.<br \/>\nYou also need to do everything properly and quickly: serve notices, post an eviction notice, and get in front of a judge as soon as you can.<\/p>\n<p>Once you get to an evidentiary hearing, they may move out or give up.<br \/>\nBecause if it\u2019s proven they manufactured false evidence for court, that can become a serious issue.<br \/>\nPolice don\u2019t love civil \u201che said, she said\u201d cases, but submitting a false document and lying under oath is serious business.<br \/>\nThat\u2019s something to consider in negotiations.<\/p>\n<figure><figcaption>Notary details can matter\u2014especially when the notary is \u201cmysteriously\u201d connected to the tenant&#8230; as sister, in-law, personal friend.<\/figcaption><\/figure>\n<div class=\"cta\">\n<p class=\"small\">If you like this kind of content\u2014whether you\u2019re a landlord, a real estate investor, or you just have a healthy curiosity about fraud investigations\u2014we can help.
