You had to have tape, scissors, copy machines, and shadows. <span style=\"font-weight: 400;\">That&#8217;s why, when hiring a forensic handwriting expert for a cut-and-paste case, it&#8217;s worth confirming they are familiar with digital forgery techniques and not exclusively trained in older physical methods.<\/span><\/p>\n<h3>Is a Cut-and-Paste Document Still a Forgery?<\/h3>\n<p><span style=\"font-weight: 400;\">Essentially, a cut-and-paste is an altered document. It falls into the classification of forgery because the creator manufactures a document that doesn&#8217;t exist. <\/span><span style=\"font-weight: 400;\">The document usually gives the impression that a party agreed to a transaction, such as a marital settlement, a prenuptial agreement, or a stock transfer, that they did not agree to.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And here&#8217;s the kicker on a cut-and-paste. You will never have an original to inspect. Often, in cut-and-paste cases, the court will say we can&#8217;t use the evidence because there&#8217;s no original wet signature. <\/span><span style=\"font-weight: 400;\">Well, guess what, judge? If there was a wet signature, it wouldn&#8217;t be a cut-and-paste. <\/span><span style=\"font-weight: 400;\">By definition, it was created on a computer, and then the doctored file was printed. It&#8217;s a catch-22 that a good attorney and a qualified forensic examiner can help you navigate.<\/span><\/p>\n<p>Even a high-quality color printout can be difficult to distinguish from a wet-ink signature, which is exactly why a forensic document examiner with a microscope matters.<\/p>\n<h3>How Can I Tell the Difference Between a Cut-and-Paste and a Wet Signature?<\/h3>\n<p><span style=\"font-weight: 400;\">So, a couple of definitions for you. A <strong>wet signature<\/strong> means the ink was wet when applied, as it came from a pen and was written by a human. In a cut-and-paste signature, you want to prove that it is your signature but you did not physically sign the altered document.<\/p>\n<h3><strong>The Key to Proving a Cut-and-Paste Forgery<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">The secret to proving a cut-and-paste (and I&#8217;ve won 100% of the trials where cut-and-paste was involved) is that you have to find the source document, and if the source document matches that signature exactly, then it\u2019s obviously a cut-and-paste. <\/span><span style=\"font-weight: 400;\">Because there&#8217;s a general rule or guideline we use in forensic document examination.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nobody ever signs their name in exactly the same way twice. That single fact is the foundation of every cut-and-paste case we&#8217;ve ever won.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It&#8217;s a fact. And because of that, there are going to be small differences between your own signature, even your initials, even if you sign a hundred times in a row. <\/span><span style=\"font-weight: 400;\">It will look the same, but there are slight differences and deviations every time you sign anything throughout your whole life. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">That rule is really helpful because that axiom tells us: if a signature looks like yours, smells like yours, and tastes like yours but you didn&#8217;t sign it, it&#8217;s because that <em>is<\/em> your signature, but it wasn&#8217;t put there by you. <\/span><span style=\"font-weight: 400;\">It was transferred from another document. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proving it is your signature and locating the original document are key to winning the case. <\/span><\/p>\n<h3>Are Cut-and-Paste Cases Expensive?<\/h3>\n<p><span style=\"font-weight: 400;\">If there&#8217;s a contract or piece of paper you know in your heart you didn&#8217;t sign, but it looks like your signature, that&#8217;s not the most expensive kind of case. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">If we have the evidence, that&#8217;s probably on the lower end price-wise. In all our cut-and-paste cases, we found the source document the signature was pulled from and had high-quality copies to use as evidence (obviously, there was no wet signature because the wet signature would have been the original).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I remember a recent case in Los Angeles where we found the source document. It was in the pile of checks turned over in evidence, but the original had been destroyed. It was the bank copy of the check, and it was, of course, two years before the document was signed. <\/span><span style=\"font-weight: 400;\">We were able to prove that the forger used the signature from that check and pasted it onto a forged document using a computer.<\/span><\/p>\n<p>Once you find the source document\u2014the original that was copied\u2014the case becomes remarkably clear.
