Will a forensic handwriting expert’s report hold up in court? If you’re going to spend $5,000 or $10,000 on a forensic expert report on anything\u2014blood, bone, age, or hair analysis\u2014you definitely want it to hold up in court.<\/span><\/p>\n

Here’s something most people don’t realize about how expert evidence actually works: reports can’t go to court. Experts and human beings go to court. That’s one of the interesting things about AI. AI will never replace an expert because an AI can’t testify. Now the AI may be able to help someone prepare a report. It may be able to perform blood, fingerprint, fingertip, or handwriting analysis, but it’s the experts themselves who go to court and testify.<\/p>\n

So, generally, unless you’re in small claims court or you’re in an arbitration, the report itself is not going to take the place of actual testimony. If you are in the pre-stages of a court case, a report is <\/span>essential for negotiating a settlement. It can also convince the other side to back off completely.\u00a0<\/span><\/p>\n

Why a Strong Report Can Win Before Trial<\/h3>\n

I’ve written a 100-page report that is so good the other side decided to capitulate and said, “We don’t want that guy in court.” They’ll stipulate that the document in question is not authentic. Or they’ll drop the case altogether, which happens more often than you might think.<\/span><\/p>\n

So, you hire an expert, you get a great report. This is not to have the report show up in court, but to have the expert’s credibility threatened so that the case may be dismissed before you have to spend another $60,000 on an attorney.<\/span><\/p>\n
